1. Acceptance of Terms

By purchasing access to any Custom GPT (“Service”) offered by CHURCH GIRL VENTURES, DBA GREATIDEAGIRL.COM,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not purchase or use our Service.

2. Description of Service

We provide lifetime access to custom GPT applications built on OpenAI’s platform. Each Custom GPT is designed for specific use cases and is accessed through direct links provided upon purchase. Our Service is dependent on OpenAI’s infrastructure and policies.

3. Purchase and Payment

3.1 Pricing

All prices are listed in US Dollars and are final at the time of purchase.

3.2 Payment Processing

Payment must be received in full before access is granted. We use third-party payment processors and are not responsible for payment processing delays or failures.

3.3 No Refunds

ALL SALES ARE FINAL. Due to the digital nature of our Service and the immediate access provided upon purchase, we do not offer refunds, exchanges, or credits under any circumstances, including but not limited to:

  • Change of mind
  • Dissatisfaction with the Service
  • Technical difficulties on your end
  • Changes to OpenAI’s policies or platform
  • Discontinuation of the Service

4. Access and Use

4.1 License Grant

Upon payment, we grant you a non-exclusive, non-transferable, lifetime license to access and use the purchased Custom GPT(s) for your personal or business purposes, subject to these Terms.

4.2 Access Method

Access is provided through direct links to the Custom GPT on OpenAI’s platform. You are responsible for maintaining the confidentiality of these links.

4.3 Account Requirements

You must have a valid OpenAI account to use our Custom GPTs. We are not responsible for any issues with your OpenAI account.

5. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Prohibited uses include, but are not limited to:

  • Any illegal activities or purposes
  • Generating harmful, abusive, or offensive content
  • Attempting to reverse engineer or replicate the Custom GPT
  • Sharing access links with unauthorized third parties
  • Commercial resale of access without written permission
  • Any activity that violates OpenAI’s Terms of Service or Usage Policies

6. Third-Party Dependencies

6.1 OpenAI Relationship

Our Service is built on and dependent upon OpenAI’s platform. We are not affiliated with, endorsed by, or sponsored by OpenAI.

6.2 OpenAI Policy Changes

IMPORTANT: OpenAI may change their policies, terms, pricing, or discontinue services at any time. Such changes may affect or terminate access to your Custom GPT. We are not responsible for any changes made by OpenAI that impact your access to the Service.

6.3 Platform Availability

The Service depends on OpenAI’s platform availability. We do not guarantee uninterrupted access and are not liable for downtime caused by OpenAI or other third-party services.

7. Privacy and Data

7.1 Data Processing

Your interactions with the Custom GPT are processed according to OpenAI’s Privacy Policy, which can be found at https://openai.com/privacy/. We recommend reviewing their privacy policy before use.

7.2 Our Data Collection

We collect minimal data necessary for providing access and may retain purchase information for business records. We do not monitor or store your interactions with the Custom GPT.

8. Disclaimers and Warranties

8.1 No Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Content Disclaimer

We do not control or monitor the outputs generated by the Custom GPTs. You are solely responsible for your use of any generated content and must verify its accuracy and appropriateness for your needs.

8.3 Results Not Guaranteed

We make no guarantees about the performance, accuracy, or results you may achieve using the Service.

9. Limitation of Liability

9.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE.

9.2 Excluded Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

9.3 Third-Party Actions

We are not liable for any actions, changes, or policies implemented by OpenAI or other third parties that may affect your access to or use of the Service.

10. Age Restrictions

You must be at least 13 years old to use our Service. If you are between 13 and 18 years old, you must have parental or guardian consent to purchase and use the Service.

11. Intellectual Property

The Custom GPTs, including their design, prompts, and functionality, are our proprietary property protected by intellectual property laws.

11.2 Your Content

You retain rights to any content you input into the Custom GPT, subject to OpenAI’s terms regarding content processing.

12. Termination

We reserve the right to terminate your access to the Service immediately if you violate these Terms, though refunds will not be provided.

12.2 Effect of Termination

Upon termination, your right to access and use the Service immediately ceases.

13. Changes to Terms

We may update these Terms at any time by posting revised Terms on our website. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be resolved in the courts of Tennessee.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
